Terms of service

These Terms of Service ("Terms") apply to your use of www.trycrunchy.com (the "Site") and to every purchase you make from it. The Site is operated by APPCARES LLC, doing business as Crunchy ("Crunchy", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms, our Refund Policy, our Shipping Policy and our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree that the information you give us at checkout is accurate and complete, and that you are authorized to use the payment method you provide.

2. Products and descriptions

We work to describe and show our products accurately. Colors can look different on different screens, and product photos may show accessories or settings that are sold separately. Performance figures such as battery life, refill intervals and noise levels are measured under test conditions and vary with settings, water level, room conditions and use. We may update product designs, materials and packaging without notice, as long as the change does not reduce the product's core function.

3. Prices and payment

All prices are in US dollars. Prices, promotions and bundle offers can change at any time, but a change will not affect an order we have already accepted. Discount codes cannot be combined unless the offer says so, and have no cash value. Payment is taken in full when you place your order, including for pre-orders.

If a product is listed at an incorrect price because of a typographical or system error, we may cancel any order placed at that price and refund it in full, even after you have received an order confirmation.

4. Orders

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, limit quantities per customer, or ask for additional verification, including when we suspect fraud, resale or an error. If we cancel an order after you have paid, we refund it in full.

5. Pre-orders

Some products, including the Steel Edition, may be sold as pre-orders. A pre-order ships by the date shown on the product page when you order, which is also printed on your order as "Ships by". If we cannot meet that date, we will email you with a new date, and you can choose to wait or cancel for a full refund. You can cancel a pre-order before it ships under the cancellation terms in our Refund Policy.

6. Shipping

Shipping times, costs and what to do about lost or damaged packages are set out in our Shipping Policy. Risk of loss passes to you when the carrier delivers your order to the shipping address you gave us.

7. Returns and refunds

Returns, refunds, restocking fees and cancellations are governed by our Refund Policy.

8. Limited warranty

Every Crunchy Fountain comes with a 1-year limited warranty from the date of delivery against defects in materials and workmanship under normal household use. Lifetime Care+, where purchased, extends pump coverage for the life of the fountain. If a covered defect appears, we will repair or replace the item, or a part of it, at our choice and at no cost to you. To make a claim, email support@trycrunchy.com with your order number and a photo or short video of the issue.

The warranty does not cover damage caused by chewing, drops, misuse, neglect, accidents, use of parts or accessories not supplied by us, modification, failure to clean the fountain as directed, or normal wear such as scratches and discoloration. The warranty covers the original purchaser only and is not transferable.

9. Using your fountain

Follow the instructions supplied with your product. Clean and refill the fountain as directed, check the water level regularly, and keep cables and small parts away from pets that chew. A fountain is a way to serve water; it does not replace veterinary care. If your pet shows signs of illness or is not drinking, contact your veterinarian.

10. Talk to us first

If there is a problem with your order, please email support@trycrunchy.com before opening a dispute with your bank or card issuer. We reply within 1 business day and can usually fix the problem faster than a dispute can. Nothing in these Terms limits any right you have under applicable law or under your card agreement.

11. Reviews and content you send us

If you send us a review, photo, video or other content, or tag us on social media, you give us a non-exclusive, royalty-free, worldwide license to use, reproduce, edit and display it, together with your first name and last initial, on the Site, in marketing and in advertising. You confirm that the content is yours, is accurate and does not infringe anyone's rights. We may decline or remove any content at our discretion.

12. Emails and text messages

If you opt in to marketing emails or text messages, you can opt out at any time using the unsubscribe link in any email or by replying STOP to any text. Message and data rates may apply. We will still send messages about your orders, such as confirmations and shipping updates.

13. Intellectual property

All content on the Site, including text, images, video, logos, product designs and the Crunchy name, belongs to us or our licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.

14. Prohibited use

You may not use the Site for any unlawful purpose, to place fraudulent orders, to buy products for unauthorized resale, to interfere with the Site's operation or security, or to scrape, copy or harvest its content by automated means.

15. Disclaimer

Except for the limited warranty in Section 8, the Site and our products are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.

16. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

17. Indemnity

You agree to indemnify and hold harmless APPCARES LLC and its members, employees and partners from any claim, loss or expense, including reasonable legal fees, that arises from your breach of these Terms or your misuse of the Site or our products.

18. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that is not resolved informally will be heard in the state or federal courts located in New York, and you and we consent to their jurisdiction. Either party may bring an individual claim in small claims court where it qualifies.

19. Changes

We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order. The "Last updated" date above shows when they last changed.
